Germany's revolutionary Solar Package I: on the way to a bright future

On 16 August 2023, the German federal government adopted the pioneering Solar Package I (Solarpaket I), a package of laws that revolutionises photovoltaic installations and paves the way for a sustainable energy future. The Solar Package, which emerged from intensive industry discussions and practical checks, aims to accelerate the expansion of photovoltaic systems and reduce bureaucratic hurdles in order to advance the energy transition in Germany.

Simplification for balcony PV systems One of the core measures is the removal of red tape for balcony PV systems. The previous registration with the grid operator is no longer required, and registration in the Marktstammdatenregister (German market master data register, MaStR) is limited to a few easy-to-enter data points. This makes commissioning considerably simpler and more accessible. These changes are an important step towards making it easier for citizens to use solar power and supporting the energy transition from the grassroots.

Collective building supply and tenant electricity The new model of collective building supply (Gemeinschaftliche Gebäudeversorgung) makes it possible to pass PV electricity on directly within a building to tenants or apartment owners, which extends and improves the tenant electricity model (Mieterstrom). The rules also include relaxations in the technical requirements and support for tenant electricity on commercial buildings and ancillary facilities such as garages.

Flexibilisation and extension of the provisions The Solar Package also includes adjustments to the thresholds for commercial PV. Plant operators who were previously subject to the direct marketing obligation can now pass on their surplus quantities to the grid operator without remuneration, which benefits in particular systems with high self-consumption. In addition, simplifications are introduced for the aggregation of systems and for the direct marketing of smaller systems of up to 25 kW.

Sustainable expansion of ground-mounted systems Another focus is the sustainable expansion of ground-mounted systems. The Solar Package contains rules to make more land available for solar parks while at the same time safeguarding agricultural and nature conservation interests. Support for agri-PV and other special solar systems is being extended, while the use of agricultural land is limited appropriately.
